The death of a loved one is a very difficult time and many questions arise as to what needs to be done with the decedent’s individual and/or joint property. The administration of a deceased’s estate can be handled in different ways, depending on the decedent’s circumstances. Is there a surviving spouse? Did the decedent have significant assets and/or debts at the time of death? Was there a Will? Was there a Trust? Does the decedent’s estate need to be probated? An informal administration is the most common option used to probate an estate. However, there are other options, including formal administration and special administration. Sometimes all that needs to be completed are a few forms to transfer a decedent’s property.
